Goodley McCarthy Amends Unpaid Overtime Lawsuit Against Buckley Cable Construction to Add Claim of Unlawful Retaliatory Terminat

On July 24, 2024, the attorneys at Goodley McCarthy filed a collective action lawsuit against Buckley Cable Construction Co., a large cable construction company based in Pennsylvania, on behalf of all field worker employees of Buckley who were unlawfully denied overtime compensation (time-and-a-half) for hours worked over 40 in a workweek. Plaintiff Samuel Duggan worked on cable installation and construction projects throughout Northeastern Pennsylvania, and regularly worked over 40 hours per week, often working 55-70 hours per week. However, the lawsuit alleges, Buckley never paid Duggan or his coworkers time-and-a-half for hours worked over 40, in violation of the federal Fair Labor Standards Act.

On August 9, 2024, Goodley McCarthy amended the lawsuit to add a claim for unlawful retaliation against Plaintiff Duggan. The amended lawsuit alleges that after Buckley CEO Bill Buckley heard about the lawsuit, he immediately terminated Plaintiff Duggan’s employment, in violation of the anti-retaliation provisions of the Fair Labor Standards Act.

The lawsuit seeks unpaid overtime wages and liquidated damages on behalf of Buckley’s field workers, as well as additional damages for Plaintiff Duggan related to his unlawful retaliation.

The lawsuit is currently pending in the United States District Court for the Eastern District of Pennsylvania.
